State of New Jersey v. EDDIE DANIELS, JR. (A-4915-05T4)

In this morning’s Appellate Division decision in
State v. Daniels, the court ruled that police may conduct a full search of
the person as incident to an arrest for a criminal charge, even if the
arrest is for a petty disorderly persons’ offense. The case also contains
excellent review of the authority police maintain under New Jersey law to
conduct field inquiries, investigative detentions and arrests.
